Job Requirements of Subrogation Attorney:
JOB REQUIREMENTS (Education, Experience, and Training):
* Candidate must possess a law degree from an ABA accredited law school
* Minimum five (5) years' as an attorney and/or a minimum of three (3) years' in medical claims, subrogation, and/or medicare/medicade law as an attorney.
* The successful candidate must be licensed to practice law. Admission in multiple jurisdictions is preferable.
* Outstanding academic credentials, a strong work ethic, and excellent verbal, writing and research skills
* Knowledge of the legal elements of the causes of action and theories of subrogation that form the bases of subrogation claims.
* Knowledge of statutes and case law that govern issues specific to healthcare subrogation claims.
* Knowledge of procedural rules and common practices for conducting discovery, settlement negotiations, hearings and trials.
* Knowledge of legal research principles.
* Knowledge of computers and job-related software programs.
* Skill in negotiating with other attorneys, mediators, and adjusters.
* Skill in drafting court pleadings.
* Skill in analyzing and applying legal standards.
* Skill in the delegation of responsibility and authority.
* Skill in decision making and problem solving.
* Skill in interpersonal relations and in dealing with the public.
* Skill in oral and written communication. Excellent attention to detail and analytical skills
* Effective communication skills, written, oral, and listening
* Ability to orchestrate large volumes of data and meet critical deadlines
* Strong internal and external client service skills
* Must be very motivated and have a strong work ethic
* Must be proficient in MS Office Applications
* Must be able to work independently and as an effective team member
* Required licensures, professional certifications, and/or Board certifications as applicable
* Individual in this position must be able to work in a standard office environment which requires sitting and viewing monitor(s) for extended periods of time, operating standard office equipment such as, but not limited to, a keyboard, copier and telephone

JOB SUMMARY:This role provides counsel to the Subrogation Team and assisting in supporting all aspects of the organization's Subrogation operations. .
JOB ROLES AND RESPONSIBILITIES:
1. Possesses current knowledge of any and all relevant State and Federal, including Medicare and Medicaid, laws impacting healthcare subrogation and proactively monitor legislative and judicial legal developments.
2. Builds and maintains strong internal stakeholder and external client relationships
3. Evaluates, develops, and executes strategies for the successful litigation of subrogation claims.
4. Conducts discovery and oversees outside counsel in connection with subrogation litigation claims; attends court hearings and mediations as necessary to advocate for clients' position on legal issues.
5. Negotiates settlements with third-party defendants, third-party insurance carriers, and attorneys
6. Proactively identifies and communicates risk to internal and/or external stakeholders and provides recommendations on how to mitigate that risk.
7. Provides counsel to recovery team on complex subrogation legal issues
8. Coordinate recovery activities and provide legal research and counsel for recovery team members
9. Prepares and conducts training sessions for the subrogation departments as required.
10. Draft of generate any and all settlement documents needed to conclude payment on files and closure of same
11. Collaborate, coordinate, and communicate across disciplines and departments.
12. Ensure compliance with HIPAA regulations and requirements.
13. Demonstrate Company's Core Competencies and values held within.
14. Please note due to the exposure of PHI sensitive data -- this role is considered to be a High Risk Role.

JOB SCOPE:
This individual works independently under minimal supervision and with considerable discretion to make decisions that affect Subrogation operations within the Company. The incumbent applies comprehensive knowledge of principles, practices, and procedures to complete job responsibilities. The incumbent acts as a resource for Subrogation Department staff. Work requires basing decisions on sound logic and rationale; advancing problems or issues toward resolution when encountering ambiguity or uncertainty; choosing the best alternative based on consideration of pros, cons, tradeoffs, timing and available resources; making timely decisions on problems and issues requiring immediate attention; and making sound decisions on complex functional issues and problems. An incumbent may have direct subordinates but will generally provide work direction to others who do not directly report to this job.
The salary range for this position is $120,000 - $130,000. Specific offers take into account a candidate's education, experience and skills, as well as the candidate's work location and internal equity. This position is also eligible for health insurance, 401k and bonus opportunity.
